Terms of Use
Effective 13 October 2026
These terms apply to your use of the Hypad website and app (the “Interface”), operated by [Operator legal name] (“we”, “us”). By using the Interface you agree to them. If you don't agree, don't use it.
1. What Hypad is
Hypad is an interface to smart contracts on the BESC HyperChain network. The contracts let anyone create a token, trade it on a bonding curve, and move its liquidity to a decentralised exchange when the curve fills.
- We never hold your funds or keys. You connect your own wallet and approve every transaction yourself. Transactions run on a public blockchain, are final, and cannot be reversed, cancelled or refunded by us.
- The smart contracts run independently of the Interface. They can also be used without it, and we cannot change a transaction once it is on-chain.
- Tokens on Hypad are created by users, not by us. Listing a token is not an endorsement.
2. Who can use Hypad
- You must be at least 18 years old and able to enter into a binding agreement.
- You must not be a person or entity subject to sanctions, or located in a country or region where using the Interface, or creating or trading tokens, is prohibited.
- You are responsible for following the laws that apply to you, including tax laws.
3. Your wallet
You are responsible for your wallet, its keys and recovery phrase, and every transaction you approve. We cannot recover lost keys or funds. Check each transaction in your wallet before you sign it.
4. Launching a token
If you create a token, you are responsible for it and for everything you publish about it. You agree not to:
- use names, logos or content that infringe someone else's rights, or impersonate a person, brand or project;
- make false or misleading claims, promise returns, or present the token as an investment product;
- use a token to defraud, manipulate markets, launder money or break any law;
- publish illegal, hateful, sexual or otherwise harmful content.
A token's name, ticker, description, links and image are published to the blockchain and to IPFS, which are public and permanent: they cannot be edited or deleted afterwards. We may hide any token or content from the Interface at our discretion, but we cannot remove it from the blockchain or IPFS.
5. How the protocol works
- Bonding curve. Each token starts on a curve: its price rises as people buy and falls as they sell. Prices can move quickly.
- Graduation. When the BESC raised reaches the token's target, liquidity moves to a decentralised exchange (currently BESCSwap). The liquidity is locked permanently: no one, including us and the token's creator, can withdraw it. Tokens the pool doesn't need are burned. There is no guarantee a token will ever graduate.
- Delayed graduation. If the exchange refuses the liquidity, the token waits at 100% and trading on the curve pauses until someone retries. If it still can't graduate after 3 days, selling on the curve reopens.
- Position NFTs and staking. Buying on the curve gives you a position NFT. Staking it earns a share of that token's curve trading fees, weighted by the BESC you put in. The weight does not drop if you later sell your tokens. Staking rewards stop when the token graduates.
- Reward tokens. Some tokens charge a tax on exchange trades after graduation and pay it to holders. The creator chooses what holders are paid in, and when collected tax is converted, so rewards are not guaranteed. Creators can lower taxes but never raise them.
- Referrals. A referral link credits the referrer with part of the trading fee on your trades. The first referral code you use applies permanently.
6. Fees
- Trades on the bonding curve pay a trading fee (currently 3%), shared between the protocol treasury, the token's creator, position-NFT stakers and, where applicable, a referrer. The fee can be lowered but never raised above 3%.
- We may charge a launch fee (at most 10 BESC) and a graduation fee (at most 5% of the BESC raised). Any fee in effect is shown in the Interface before you sign.
- You also pay network gas, the exchange's own fees after graduation, and any tax a reward token charges. Fees are not refundable.
7. Risks
Using Hypad involves serious risk. You accept that:
- tokens can lose all of their value, and you may lose everything you put in;
- smart contracts can contain bugs or be exploited; audits reduce but do not remove this risk, and we do not guarantee the contracts are free of defects;
- the BESC network, BESCSwap, wallets, RPC nodes, IPFS gateways and other third-party services can fail, change or be unavailable;
- token creators and other users may act in bad faith, and we cannot vet them;
- blockchain data shown in the Interface, including prices, charts and estimates, may be delayed or wrong;
- laws and regulation around digital assets are uncertain and can change.
8. No advice
Nothing on Hypad is financial, investment, legal or tax advice, or a recommendation to buy, sell or hold any token. Do your own research and consider getting independent advice.
9. Prohibited use
You agree not to:
- attack, overload, scrape at scale, or interfere with the Interface or its infrastructure;
- abuse sponsored (gas-free) launches, for example with many wallets, or bypass rate limits;
- exploit bugs, or use the Interface for anything illegal or harmful to others.
10. Third-party services
The Interface links to or relies on services we don't control, including wallets, BESCSwap, block explorers, IPFS and hosting providers. Their own terms apply, and we are not responsible for them.
11. Intellectual property
The Hypad name, logo and Interface design belong to [Operator legal name]. Content published by token creators belongs to them or their licensors; by publishing it through Hypad you confirm you have the right to.
12. Disclaimers and limitation of liability
The Interface and the smart contracts are provided “as is” and “as available”, without warranties of any kind. To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for any loss of funds, tokens, profits or data, arising from your use of Hypad, the smart contracts or any third-party service. Where liability cannot be excluded, it is limited to the fees you paid to the protocol treasury in the 12 months before the claim.
You agree to compensate us for claims and losses that arise from your breach of these terms or misuse of Hypad. Nothing in these terms limits rights you have under laws that cannot be excluded.
13. Changes and access
We may update these terms; the effective date above shows the current version, and continuing to use Hypad means you accept it. We may change, suspend or stop the Interface, or restrict access to it, at any time. This does not affect the smart contracts or your assets on-chain.
14. Governing law
These terms are governed by the laws of [jurisdiction], and disputes will be handled by the courts there, unless the law where you live requires otherwise.
